Workshop on Professional Conduct and Ethics of the Lawyer's Industry

On 25 March 2021, Shanghai Orient Cambridge Law Firm held the second workshop on professional conduct and ethics of the lawyer's industry. All lawyers participated in the workshop through either attending in person or online viewing.

The first part of the workshop is discussing the Chinese Communist Party’s history, lectured by our partner Ms Song Jing. She explained the significance of studying the Party’s history, its four historical periods, and the Party's basic knowledge, including its nature, fundamental purpose, political advantages, original aspiration and mission, two upholds, and four consciousnesses.

The second part of the workshop is case study of several punishment cases published by Shanghai Justice Bureau, lectured by our partner Xiang Ping. The following cases were discussed:

1. Cases of improper contact with judicial personnel

Two cases of lawyers being punished for bribery

2. Practice in violation of Laws and Regulations

  • Five cases of lawyers being subject to administrative punishment for interfering with the litigation procedure
  • A case of lawyer being punishedfor providing false materials to the judicial administration department
  • Two cases of lawyers being punished for violating fee regulations
  • A case of a lawyer being punished for violating fee regulations and refusing to act as a defense lawyer without proper reason
  • A case of a lawyer being punished for undertaking business by improper means

  • "Several Provisions of the Shanghai Justice Bureau on the Criteria for Judicial Administrative Penalty"

The third part of the workshop is for our Managing Partner, Mr Xiao Wanhua, to emphasize the importance and significance of the Party’s history learning and its relevance in all aspects of work, and to remind all lawyers to strictly abide by their professional ethics and avoid violating laws when carrying out work.
